Is this worth going through insurance to fix?

Or should I avoid insurance and fix it out of pocket? If I do Im just getting the hood replaced. I live in NYC and afraid my premium will go up if I file a claim

Or leave it alone?

I'd get it fixed.

If you don't fix it, you'll take the loss when the car is sold.

If you do fix it, you can appreciate it while you still own the car.

I could not give you an estimate. Getting one from a body shop will help bring things into focus.

Shop around. Get two or three estimates. The numbers will help you decide to involve a claim or pay cash.

Aren't the store liable for a runaway trolley? Cleary didn't originate from a trolley bay just floating around on its own. You have it on camera, so I'd have thought it's worth a try.

this isn't an accident so it should go under the 'comprehensive' part of your insurance, which is for act of God stuff like this. I know insurance companies are dirty bastards, but if they jack your rates over something like this I think I'd be looking for a different insurance company.

Talk with the store manager, their insurance should cover it; without needing to contact yours at all.
If the body shop repair will end up on CarFax, which it most likely will, see about also getting diminished value payment as well.

I believe the part in front of the hood is part of the bumper, which is plastic. If so, that hole is most likely not repairable; meaning you will need a bumper too.

Disclosure: I am not a lawyer and have zero legal experience.

Thinking of the liability issue...

Was that a loose cart a customer left out in the open? The store needs to make a holding area available for customers and maintain that. But chasing after every loose cart a customer leaves behind every moment...it's difficult to see any store being held liable for that. Think of all the claims. The potential for fraud.

Was that a cart that came loose from a holding area? Were the holding areas full, leaving customers to park them anywhere? I can see the store being at fault for that.

But ya, check with the store.
