who knows. I don't think Ford would intentionally lower the recommended capacity, knowing it may cause warranty issues. the only thing I could figure is maybe the lesser capacity is intended to lower the oil level in relation to the crankshaft to avoid aeration issues in the oil (and mabe squeeze every last drop of fuel economy out of the engine). either way if I read the manual, under oil capacity and specifications, it doesn't mention whether to add a half a quart to the capacity for the performance package or Dark horse models with the added oil cooler. unless they figure the oil does not drain out of that system on an oil change. I did see on the Ford performance website, that the stamped steel oil pan was listed at a capacity of 9.5 quarts but that's without a filter also.
