No offense, but no they won't. They will sell the car without any problem. Beyond that, they are no more obligated to sell you a car than you are obligated to buying it.
I tell people all the time: If you're not wanting some crazy custom order but they want a non-refundable deposit, turn around and walk out the door - they are crooks, and that won't be the only time they screw you.

The 3.15 is an option because a huge chunk of buyers neither know nor care what ratio they have and putting the 3.15 in a bunch of Mustangs gives Ford better overall MPGs to meet CAFE and federal requirements (and avoid fines/fees).

Your contract is with NEXUS, not with whomever NEXUS hired. That's not the way it works. They're telling you that hoping that you'll believe them. Depending upon the amount of damages, I'd pay an attorney a few dollars to send NEXUS a letter.
