I received a letter in the mail from the EPA advising that my vehicle was observed in Collins Street Melbourne by an authorised officer, who considered the vehicle to be excessively noisy.

I typically drive it in Sport mode, and the car is stock. So I've had to book it in for testing in a couple of weeks time. Speaking with the testing provider he said I've got nothing to worry about if it's stock.

What a pain

What a crock of shit, did they provide any evidence or was it just some EPA chump (probably in Lyra) sipping a latte?

Humans are unable to determine what is legal or not by ear, you shouldn't need to get it tested or pay for the testing.

Nope no evidence.

Being City of Melbourne it’s full of Greens. Fair chance I’ve upset one.

I have no choice but to get the test done. I’ll be interested to know if it happens again am I obliged to test again?

7 years with my S550 with Borla S-Type Axle Back and never had a problem. I suspect it was just bad luck with who I upset.

ie; what if some PITA reports it the week after?

I just called the EPA

The report is valid for 3 months and if it is reported again in that time the report will be dismissed. If it occurs after the 3 months another notice will be issued. From there I learned that there is a dispute process where you can submit reasons for it to be dismissed. My approach would be to prepare a Statutory Declaration that swears that the vehicle exhaust is stock. They could though play hard ball I guess and argue that the exhaust may be damaged.

Hopefully it was just bad luck with who I pissed off by just driving my car in a legal and responsible manner.

For what it's worth I just lodged an appeal online to withdraw the notice.

I said it's a unmodified vehicle less than two months old with just over 1000 km's on the clock and is in showroom condition.

I've got my booking in place with the tester and will have that done if my appeal is rejected or not responded to before the booking I have on 31st October.

The EPA person I spoke to said stock vehicles can be non-compliant due to mechanical damage. I said I understand that but this car is brand new.

I'm hoping that common sense will prevail, but I'm expecting the worst.

I would have thrown the letter in the bin.
Might feel good at the time, but there's possible consequences.

"If EPA does not receive a CoC from you by the due date of this notice, you may be guilty of an offence and legal action may be taken against you

If you do not submit a CoC to EPA, it will be an offence to do the following;

  • Sell the vehicle without permission of EPA
  • Use the vehicle after the due date of this notice (except for the purpose of obtaining a CoC)."

Just received the following after I submitted my appeal


“Environment Protection Authority Victoria (EPA) has received your internal review application. Your infringement will be on hold while your application is being reviewed.
EPA must determine internal review applications within 90 days. This timeline will be extended if we request more information from you during the assessment. An independent internal reviewer will review your application. You will be notified of the outcome of their review in writing.

So the clock has stopped. Good to know that for any future issues”

I plan to keep my testing appointment in place for Oct 31st. If push comes to shove I want that test certificate for future issues if they arise. Test cost is $130 which really pisses me off but I think it’s money I have to spend to get this crap sorted.

I’ll arrive at the testing centre set to Normal mode and leave it to them to test it. The tester an exhaust specialist and looking at their website they do a lot with performance vehicles so I’m expecting a warm welcome

When you get the certificate, take a trip down Collins street on the same day and time and rev the shit out of it in drag mode

Also going to let Ford Australia know and make it their problem and ask for documentation that validates compliance

This is ridiculous

Do not move up here.
We've had enough Mexicans move north from NSW and Danostan since COVID.
Traffic congestion has become noticeably worse in the last 4 years because of this.

QLD and WA need to build walls !!!!
